Do I read this right? The lady hit nobody until after she was rear ended and then only because her car was pushed into a collision? Interesting case. I thought most places assumed the driver who rear ended her was at fault for not allowing enough room before the car in front. After all, no telling what the other guy/girl may be required to do, like slam on brakes all of a sudden.

Would a guy been held responsible for an identical accident?

did you catch the part that she was driving recklessly?
i think it would be safe to assume that had she been driving like a normal law abiding human being she "might" have had enough space between her car and the other one infront of her..

and yes, a guy would have been held responsible. its not a gender issue. what makes this case interesting is the fact that she is paying diyyah for her own unborn child.

I guess you have to have some knowledge of the details of the actual situation to really know. A little hard for me to envision why, if she was driving recklessly, didn't the driver behind her give her lots of room to do something else reckless. If her first sign of "reckless" driving consisted of slamming on the brakes, seems like the driver behind is still responsible for the accident. Would be in the US. Still, I wasn't there.

If she is the reason for the child to get lost then it is normal to pay, and it is Sad thing but in life anything can happen...

Connor, the mentality or reasoning is somewhat different.
for example, back in the 80's my uncle was going at about 180 kph in saudi when his tire blew, throwing the car out of control and eventually colliding with another car, killing the passangers in the other car. Although my uncle was not responsible for the tire exploding, he was driving at an excesive speed. hence he had to pay diyyah for the passangers in the other car.

Hi Mishu
I have been out of it /off the board for quite a while and just checking back-good to see familiar faces still here!. This part of the thread reminded me of an acquaintance that was stopped at a red light over in the Al Sadd section of Doha (Qatar) when we lived there... he and 6 other cars stopped at a red light. A person came out of a side street in excess of 60 mph, hit him and other cars (stopped at the red light) and he and a few others were found at fault as they "came to the country of their own free will." Had us all scratching our heads for sure... We had a few drinks laughing about that one! While they had no Diyyah to pay, they did end up liable for the accident. Just goes to show different places different rules/laws.
