while down in Baja last year i was told that muti-band guns were illegal and considered weapons. i thought otherwise. and some people say it's a gray zone in the law. so what i want to know is are they legal or not?

Multiband guns are legal in Baja, but spearfishing on scuba is not.

People, especially fisherman, will tell you all kinds of things to discourage you. And of course the law in Mexico can be whatever a policeman or warden says it is, and he might hope you will just give him a bribe rather than go to the trouble to prove him wrong.

Baja is funny because there is only one three man team in all of Southern baja in charge of game fishing. So it is very hard to figure out what is legal and what isn't. It is my understanding that all sport spearfishing is perfectly legal and the amount of fish you can take spearing is the same as fishing. I havn't checked how much that is (i don't take very much) but i'm sure a lot more people know the facts about angling than spearing.

Most of the "laws" you hear about are rumors like bill said. many times they are started because someone hears something that pertains to commercial fishing and mistakes it for a law about sport fishing.

I like the advice of my friend Milton Sanders,
"Always assume that what you are doing is illegal. So don't get caught."

But don't take lobster. That is clearly illegal for gringos.

Ok Guys, it is in the law and it is like this

1. Spearfishing is legal only with band guns
2. Pneumatic guns are not legal (i jus don't know the reason)
3. Only freediving spearfishing is legal
4. You need a sport fishing licence
5. You can only shoot 5 fishes per person per day (anglers can take 10, again I don't know the reason for this)
6. You can only take fish with that licence, not crustaceans nor moluscs (Bill, it is for everybody not only for gringos)

Enjoy your spearfishing !!!
