Tidal rivers!?

I have had a thought, is it legal in the UK to spearfish in the tidal stretches of rivers? Not that I have any particular desire to do so but it would be good to get a definitive answer. As far as I am aware it is illegal to spearfish in any non tidal stretch or body of water. What do you think? :)
