AlphaDeep wetsuits - stay away

Thread Status: Hello , There was no answer in this thread for more than 60 days.
It can take a long time to get an up-to-date response or contact with relevant users.

I said early on that "I definitely wouldn't" but now they have completely blown it. Even if it was the difference between diving in a 2nd hand surfing suit and something of theirs I wouldn't give them a penny.

I think I see some true colours shining through here.
 
Unbelievable action by them! Instead of responding with something that would make me think they are good business people and make me consider possibly buying one of their suits, they choose to turn many people completely off from ever buying from them. This is hard to understand! I have referred others to their site and now I feel I better warn them also.
 
They have formally advised they are launching legal action against DeeperBlue.com. I am awaiting details of the legal action and will need to take appropiate action once I know more.

A note to everyone: if you post a warning against alphadeep suits to other forums, blogs, or websites, please avoid posting the address of their website! In fact using negative reactions and the way they are processed by Google, is the way many crooks turn into their profit. There are even companies that intentionally do everything to stir a huge wave of online critics, because it improves their position on Google.

So please do not make them the favor, and please avoid ever using the name of their domain anywhere online! I'd recommend that Nostres or Stephan remove the link to their website from this thread too - any link on an external website, and especially on such a highly ranked as DB, helps them generating more visits and more business (regardless of the real content of the posts)

I wish to advise that at this time, I am not co-operating in any defamation, and this accusation is both libellous and absurd. I further state that as a user of the internet and twitter, I am exerting my legal right to freedom of speech and freedom of expression.

These rights are recognised under Article 19 of the Universal Declaration Of Human Rights, International Human Rights Law, and in the International Covenant On Civil And Political Rights. Article 19 of the latter act states quite clearly:
“everyone shall have the right to hold opinions without interefience” and “everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice”.

Therefore as a member state of the EU, being governed by the acts stated above, I can see quite clearly that your email is without basis, merit and lacking substance.

If you feel that you are being persecuted in any way whatsoever, may I kindly suggest that you rectify the issues with the persons who exercised their right to freedom of speech and expression.

Finally, I will continue to exercise my right to freedom of speech and expression and will make your email and my response publicly available.

Guys, please avoid posting the name of their domain here or anywhere else! And I mean including the email address. Google spider pciks it up, and since DB is a highly valued website, any links to their server help them getting better ranking in search results.

If any moderator sees this post, I'd suggest considering removing the name of their domain from all threads in DB forum. Why helping them, when they threaten DB with legal actions?

I'll edit my post. But just to clarify, if the spider picks them up, they'll also be picking deeper blue up too, so moving this thread up the ranks also?

I quite honestly think their basis for action is rediculous and arrogant, and the entire matter could just 'go away' if they pulled their necks back in and just refunded the OP in full.

No, it would happen only if this thread was linked from 3rd party websites. In that case it would help them again too. And proportionally they'd profit more from it.
 
The thread is clearly violating the rules of the forum.
The words used :Stay away (defamation), Nigerian scammers (defamation),advicing our potential customers to not buy(defamation),pubblication of private e-mails(crime),violing of privacy(crime),and now hate anthem of our Company.

We have advised several times the person who wrote and the ADMIN of the forum,explaining that they were committing crimes and defamations on purpose, but they didn't heard us.We also advised them before the legal action and we also suggest to tolk with their legal.

We remember that it's not possible to take legal action with out the consense of the POLIZIA so it's clear that there are crimes and defamation.
We remember also that we are not scammers,but we apply rules of our Company, THE CONFIRMATION IS PAYPAL.(They are also scammers???).

We remember also the rules of ADMIN And Moderator.
Is to maintain an attitude appropriate, without instigating and creating provocative post,(in this case to denigrate purposelly our Company).
And they are the co-responsable of what people wrote.

I hope that is clear.

About email privacy (putting moral aspect aside) only the last email from them- the one informing about legal action includes privacy disclaimer below.

Ravelo all this boils down to one thing - you just didn't handle this whole thing right (not even in a way that is in the best interest of your company).

Seriously, forgetting for a moment about who's right/wrong and defamation, crimes, police and lawyers - how do you think the way you are handling this is working out for you?

I am really struggling to understand - you are willing to go through all this hassle, damage your companies reputation, spend money on legal fees etc etc instead of giving 60 euros back to someone that after all must have liked your suits and all he wanted to do was order (which in fact he did!)?

You gave me no product, no service so You don't deserve it, simple.

Scammers from country - Nigeria, send me tens of emails almost daily starting with "Dear sir/madam" therefore I simply call them what they are

You provide me service that begs for me to warn my friends and advice to stay away, what did You expect?
 
Ravelo - you're taking legal action and threatening legal action for defamation but there's a serious flaw in your thinking...
It isn't defamation if it is TRUE.

You have treated a potential customer in an appalling manner and he has posted his experiences on here for our information. If that was defamation every single review website, magazine, TV or radio show would be guilty of defamation too. It isn't, and they are not.

Many times I've seen someone post about a problem with a company that was resolved well and I have made a point of doing business with that company because they proved themselves trustworthy and professional. The way your company has handled this incident is appalling and you have ensured I will never do business with you. It is entirely your fault and threatening people with false claims of defamation and criminal behaviour is making your public image FAR worse.

Be a man, do the right thing and resolve this situation properly. Refund the money before you do your public image any more irreparable damage.
 
Oh and just to be clear about this...
The forum owner is not guilty of defamation and I expect their legal advisor will point them to the specific defence of "innocent dissemination".
The person who AlphaDeep has been treating so badly has a series of emails and bank statements that back up his comments. I expect his legal advisor will be pointing him to the specific defence of justification.
I'm not a lawyer nor do I play one on TV so this is not legal advice, just my plain-English understanding of the really simple rules around defamation.
